These Terms of Service (“Terms”) are a binding agreement between you and the developer of Horror Mods for Minecraft PE (“we,” “us”) governing your use of the mobile application Horror Mods for Minecraft PE (the “App”). By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the App. The App contains horror-themed content and is not intended for children. By using the App you represent that you meet these requirements and that your use complies with all applicable laws.
2. License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial use. We reserve all rights not expressly granted.
3. Acceptable Use
You agree not to: (a) use the App for any unlawful, infringing, or harmful purpose; (b) reverse engineer, decompile, modify, or create derivative works of the App except as permitted by law; (c) interfere with or disrupt the App, its servers, or its security; (d) access the App through automated means or scrape data; (e) remove, obscure, or interact improperly with advertising; or (f) misuse third-party content. We may suspend or terminate your access at any time for any reason, including violation of these Terms.
4. Third-Party Mods, Minecraft & No Affiliation
The App is an independent, fan-made catalog and is not affiliated with, endorsed by, sponsored by, or associated with Mojang Studios, Microsoft Corporation, or the Minecraft brand. “Minecraft” is a trademark of Mojang Studios. The mods, add-ons, maps, and files are third-party or community content that we do not create, own, control, or guarantee. You are solely responsible for evaluating and using such content and for complying with the Minecraft End User License Agreement, Usage Guidelines, and any applicable third-party terms. You install and use third-party content at your own risk.
5. Intellectual Property
The App, including its design, code, text, and our trademarks, is owned by us or our licensors and is protected by law. Third-party content remains the property of its respective owners. If you believe content infringes your rights, contact us at zalak.upgrade@gmail.com and we will respond as required by applicable law.
6. Advertising & Purchases
The App is supported by advertising (Google AdMob) and may offer optional in-app purchases or entitlements (such as “Remove Ads”). Purchases, where offered, are processed by the applicable app store under its terms, and refunds are subject to that store’s policies. We are not responsible for app-store transactions.
7. Disclaimers
The App and all content are provided “as is” and “as available,” without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the App or any mod will be uninterrupted, secure, error-free, compatible with your device, or free of viruses or other harmful components. You assume all risk arising from your use of the App and any third-party content.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will the developer of Horror Mods for Minecraft PE be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, devices, profits, or goodwill, arising out of or relating to the App, any third-party content, or these Terms, even if advised of the possibility of such damages. Our total aggregate liability for all claims will not exceed the greater of (a) amounts you paid us, if any, in the twelve (12) months before the claim, or (b) USD $10.00.
9. Indemnification
You agree to defend, indemnify, and hold harmless the developer of Horror Mods for Minecraft PE and its affiliates, officers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, your violation of any law, or your use of any third-party content.
10. Termination
These Terms remain in effect while you use the App. We may suspend or terminate your access at any time, with or without notice. Upon termination, the license in Section 2 ends and you must stop using the App. Sections that by their nature should survive termination (including Sections 4–9 and 11–13) will survive.
11. Governing Law
These Terms are governed by the laws of India, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the competent courts located there, to the extent permitted by applicable law and without limiting any mandatory consumer-protection rights you may have in your country of residence.
12. Changes to These Terms
We may update these Terms from time to time. We will revise the “Last updated” date above and post the new version at this URL. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
13. Severability & Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force, and the unenforceable provision will be enforced to the maximum extent permitted by law. These Terms and the Privacy Policy are the entire agreement between you and us regarding the App and supersede any prior agreements. Our failure to enforce any right is not a waiver of that right.
